Thathorse Disclaimer
Thathorse refers to the legal owner of the Thathorse website which is dedicated to helping horse lovers buy, sell and learn.
The website operates by people placing listings for horses and products for sale, wanted to buy and stallions at stud. The Business Centre assists in promoting businesses which the business owner can update at any time. A person must first register as a Thathorse member in order to make a listing.
Listing Details and Charges
All content on www.thathorse.com is subject to the following terms and conditions.
When placing a 'Horse for Sale' or 'Wanted to Buy' listing, the listing time period is as long as it takes for the horse to sell or for the buyer to buy. Video of up to 5MB can be added at no extra charge for all 'Horse for Sale' listings. After 8 weeks the ability to change the listing is 'locked down'. This means that certain fields cannot be altered. It prevents Thathorse members placing multiple listings under one fee. Accessory listings are for a 12-week period. Stallions at Stud are annual listings. The costs are $250 per year/stallion for Performance Horses, or $350 per year/stallion for Race Horses. Video of up to 5MB, and 5 photos, can be added at no extra charge.
Platinum Business Listings have time periods based on their cost. For example, the charges are $900 for a 6-month listing and $1200 for a 12-month listing. These are not 'locked down' at any time and Thathorse members are free to, and encouraged to, update these listings as many times as they wish.
Standard Business Listings are annual (12 months from the date of purchase). They are $50 per year.
Charges are payable in advance and are non-refundable. Payment of charges can be made by credit card only (Visa or MasterCard). All credit card payments are administered by DPS which will hold your details secure and confidential. Thathorse does not and will not hold any Thathorse member credit card details.
Keeping your Listings Current
Thathorse members with listings in the 'Horse for Sale' and Wanted to Buy' in either the 'Racehorse' or 'Performance Horse' categories will receive fortnightly automated update confirmations. These are to keep Thathorse's website content current. Simply follow the process outlined in these emails to keep your listing active on the website. You will incur no charge when updating the 'Horse for Sale' and Wanted to Buy' in either the 'Racehorse' or 'Performance Horse' categories.
If you do not update your listing through this confirmation process your listing will become inactive and will not show on the website.
The Selling / Buying Process
The Thathorse website facilitates interaction between horse buyers and sellers who are Thathorse members. Any agreement for the sale and purchase of a horse, product or service is between the seller and the buyer. Those parties enter into the agreement at their own risk. Thathorse is not and shall not be a party to any agreement between Thathorse members, and Thathorse takes no responsibility for and is not liable in respect of any agreement between Thathorse members.
Thathorse members who make a listing are solely responsible for ensuring the accuracy of the content (including attachments) and ensuring that their listings are in accordance with generally accepted advertising guidelines. Thathorse has the right to review any listings (and attachments) and amend/remove as Thathorse considers, in its sole discretion, appropriate. Thathorse shall not be liable in any respect to any Thathorse member or any other person with respect to the content (including attachments) of any listing.
Privacy
Details relating to a person will be included in each listing and the Thathorse member making the listing agrees that (and shall ensure and warrants to Thathorse that the person whose details are listed agrees to that). Thathorse can make these details available to the public. Save as included in the listing Thathorse will not disclose listing information to other parties, unless legally required or having obtained the consent of the person whose details are in the listing. Thathorse member information may be used for statistical or similar purposes but in such event the individual Thathorse member will not be identifiable as a result of such use.
Termination of Membership
Thathorse may terminate a Thathorse member's membership at any time and at the sole discretion of Thathorse. A person who registers as a member must ensure that login details (including passwords) are kept confidential.
Changes
Thathorse may amend these terms and conditions (including charges) at any time, and such changes are effective one week after the amendments appear on the website. A Thathorse member making a listing on the website confirms their agreement with these terms and conditions at the time of registering as a member, and it is up to that person to ensure they are up to date and fully informed with respect to changes to these terms and conditions.
Liability
If a listing is made on the website and action is taken by a third party in connection with that listing, the Thathorse member making the listing agrees to indemnify Thathorse as to all liabilities including costs, fines and penalties incurred by Thathorse as a result of such action.
Thathorse is not liable for and will not accept any responsibility (whether financial or otherwise) with respect to any person and any listing, including any claims for compensation if the website becomes inactive or problems arise in respect of listing data. Thathorse will use its best endeavours to resolve any website inactivity or problems in respect of listing data as soon as reasonably practicable. To the extent Thathorse has any liability, notwithstanding these terms and conditions, such liability shall be limited to $10 in respect of any such matter.
